GRAGEPOLITAN-Mahkamah Agung (MA) RI menjatuhkan hukuman denda Rp 2 miliar kepada
PT Gamatara.
Perusahaan tersebut didakwa atas pelanggaran lingkungan hidup kasus reklamasi Pantai Cirebon.
Dana Rp 2 miliar kemudian diserahkan Kejaksaan Negeri (Kejari) Kota Cirebon ke Bank BRI Cabang Cirebon, Rabu 13 April.
“Uang tersebut berasal dari PT Gamatara yang dijatuhi hukuman denda oleh MA atas pelanggaran lingkungan hidup,” ujar Kepala Kejari Kota Cirebon, Umaryadi kepada wartawan di kantornya.
Kajari menyebutkan, sebelumnya PT Gamatara mengajukan Peninjauan Kembali (PK) atas pelanggaran lingkungan yang dilakukan tahun 2016.
Namun MA memetuskan perusahaan tersebut
terbukti bersalah dan wajib membayar denda.
“Makanya hari ini denda langsung kami masukkan ke kas negara melalui Bank BRI,” kata Kajari.
Menurutnya, dalam kasus tersebut PT Gamantara dinyatakan telah melanggar Undang-undang lingkungan hidup dengan mereklamasi Pelabuhan Cirebon.
Kasus terungkap setelah tim dari Kementerian Lingkungan Hidup (KLH) melakukan inspeksi mendadak (sidak) ke lokasi.
Dari situ, lanjutnya, hasil temuan kemudian berkas masuk ke Pengadilan Nrgeri (PN) Kota Cirebon.
“Ketika itu PN Kota Cirebon memutuskan bahwa PT Gamantara bersalah. Karena tak puas, PT Gamantara lalu mengajukan banding ke Pengadilan Tinggi (PT),” paparnya.
Disebutkannya, namun putusan yang sama juga datang dari PT. Di mana pihak PT Gamatara terbukti bersalah.
“Rupanya PT Gamantara mengajukan Peninjauan Kembali (PK) ke MA. Prosesnya panjang hingga sekarang lokasinya masih dalam status quo,” ujarnya.
Seperti diketahui, reklamasi PT Gamatara berlangsung sejak 2013 lalu. Awalnya reklamasi bertujuan untuk pembuatan dok kapal.
Namun dalam perjalanannya, PT Gamatara melakukan pelanggaran. Terutama luasan reklamasi yang awalnya 4 hektare melebihi dari areal yang diizinkan menjadi 5 hektare.(G-05))
